Lahore: Former captain Moin Khan suffered a setback in his battle against the Indian Cricket League (ICL) with a civil court here striking off his right to file written statements to a damages suit of Rs 215 million filed by batsman Muhammad Yousuf against the organisers of the rebel Twenty20 tournament.
Yousuf had filed a damages suit against the administration of the ICL seeking Rs 215 million as damages from them and the case was fixed for hearing yesterday before civil judge Hina Muzaffar. Taffazul H Rizvi advocate appeared on behalf of Muhammad Yousuf.
Yousuf had entered into a contract with the ICL but owing to a ban on the league by the Pakistan Cricket Board (PCB), he backed out and returned the advance to the ICL administration. But, according to Taffazul, the League''s administration initiated legal proceedings against Yousuf on the pretext of breaching the contract.
The court had issued notices through courier and a press proclamation to all the defendants namely Essel Sports Pvt Ltd, Game On (Pvt) limited, Moin Khan and BP Saraf, Arbitrator.
Despite proclamation in the newspaper Essel Sports and Saraf, the respondents did not appear on which the court on January 22 had started ex-parte proceeding against them while Game One and Moin Khan were directed to file written statement on the next date of hearing.
But yesterday, no one appeared on their behalf. Therefore, the judge struck off their right to file written statement. Now the matter has been fixed for evidence of the plaintiff for July 7.
